Five Types of NSW Dealings

There are several types of property dealings governed by the NSW Land Registry Services (NSW LRS). Each type of dealing refers to a specific transaction or change related to property ownership or rights.

Here are some common types of dealings you can order on Lanchecker:

1. Transfer

Transfer of ownership is a type of dealing that shows the passing of any estate or interest in land. This dealing formalises the transition of title, ensuring the new owner’s rights are protected.
It’s often ordered during the sale of property or when transferring ownership as part of a legal settlement, helping to avoid disputes and secure rightful ownership.

2. Mortgage

A mortgage document secures a lender’s interest in a property by registering a legal claim over it until the loan is repaid.
This dealing is necessary when financing property purchases or developments, as it protects the lender’s investment.It’s typically ordered to ensure that all financial obligations tied to the property are properly documented.

3. Discharge of Mortgage

This signed document certifies that the mortgage on a specific property has been fulfilled, ending the lender’s claim on the property. Once the loan has been fully paid, the mortgage is removed from the title.
This document is ordered to clear the title, ensuring there are no remaining encumbrances. It’s essential when preparing a property for resale or refinancing, as it confirms the property is free from debt.

4. Caveats

Caveats are essentially a warning that someone else has an interest in the property. The word caveat means “beware”, and is a legal notice lodged with the state land registry.
The caveat appears on the Title, so if you are considering purchasing a property look out for this red flag.
A caveat prevents any further dealings on a property without notifying the person who lodged it. This document is often ordered to protect a legal interest in the property during transactions or disputes, ensuring that no unauthorised changes can occur.
It acts as a safeguard, allowing parties to resolve their claims before any further action is taken.

5. Lease

A lease document grants temporary rights to use a property under agreed terms, typically for a fixed period.
This dealing is essential for formalising rental agreements and securing the interests of both the property owner and tenant. It ensures legal protection and clarity for both parties involved in a lease arrangement.
